I sold an SKS to a guy in NY a few months ago and had the same question. According to every source I found, an SKS does not fit the criteria of an assault weapon because they do not accept detachable magazines. The biggest difference here in NY today is of course that fact that most SKS do not use a detachable mag, so they are not AWs under the new laws.
